Terms of Business (Phangan Fun Factory Ltd.Part.)

If not stated otherwise, Phangan Fun Factory Ltd.Part., its Officers, Employees, Agents and Staff will be hereafter referred to as "Phangan Fun Factory". Other Companies working together with "Phangan Fun Factory", such as PayPal, Dive Eqipment suppliers, Insurrances, etc., will be referred to as "Partners" of "Phangan Fun Factory" and serve the purpose of ensuring high quality service to you. If not stated otherwise these partners terms of business will apply in any case involving any of them.

Bookings:

- Online Bookings:
All online bookings for dive-trips (with or without rental gear) or dive courses (SSI or PADI standard) are to be made at least one week (7 days) in advance. Any applications for dive-trips or dive-courses made less than 7 days in advance, will be processed but can not recieve any guarantees to be sceduled at your desired date. Phangan Fun Factory is licensed by the TAT (Tourism Authority of Thailand) as diving- and tour operater. Any online bookings and payments are therefore insured and safe. Online bookings will recieve a 5% discount on the total amount if paid online. We provide a safe and secure PayPal checkout system, which is accepting all major credit cards, as well as bank wires or payments from other PayPal accounts. - Phone Bookings / Short Term Bookings
For bookings via phone or in short term advance, we require your full name, resort + room number, and responsible booking agent. Your private data will be held confidential and not be shared with or sold to third parties. For more information please read our Privacy Policy.

Payment:

- Online Payment:
All services purchased from "Phangan Fun Factory" online are entitled to a 5% discount on the total amount. Online payments will be handled in Euro or on request in US-Dollar. "Phangan Fun Factory" can not be held responsible for difficulties or failure in the PayPal system. Please see the PayPal's Terms of Business. Any data collected about you from "Phangan Fun Factory" during the payment process serves to improve our services towards you and is subject to the "Phangan Fun Factory" privacy policy. "Phangan Fun Factory" reserves the right to change prices without prior notice.

- Other Payments:
If not purchased online, all services of "Phangan Fun Factory" will be handled in Thai Baht and are to be paid cash to the accountable booking agent or "Phangan Fun Factory" staff where you have purchased the service. "Phangan Fun Factory" reserves the right to change prices without prior notice.

- Credit Card Payments:
Phangan Fun Factory is accepting all major credit cards. Online as well as in our shop. Please note furthermore that refunds on credit card payments can and will only be made after the 'cancelation period'(varies between companys) has expired. The exact period or amount of time can be provided by your Money Institute (In most cases 4 - 5 weeks after the initial payment).
This serves as a fraud protection, for you and Phangan Fun Factory. All payments made by you and/or your credit card will be on hold (frozen) until the 'cancelation period' expires.
If you suspect any unauthorized activity with your credit card, please contact your card provider and Phangan Fun Factory immedeatly.

- Prices:
All Prices are subject to change without prior notice.

Insurance:

- Diver Insurance:
"Phangan Fun Factory"s standard diver insurance is provided by AIG and covers accidents and incidents including death up to 200.000 Thai Baht. If you have a diving insurance or traveling insurance of your own please notify "Phangan Fun Factory"s staff about your insurance conditions. If you fail to provide any of the former mentioned information and/or provide wrong information, "Phangan Fun Factory" and it's partners can not be held responsible and you will be excluded from resulting insurrance claims. (For more information see: "Liability Waver/Release")

Services:

- Offered Services:
Any purchase, online or in person, of services offered by "Phangan Fun Factory" entitles the purchaser recieve this service as determined by "Phangan Fun Factory"(Dive Trips) or SSI standards(Dive Courses) or PADI standards(Dive Courses). If you have attended a diving course with "Phangan Fun Factory" and you are unable to finish the dive course, a percentage dependend on already provided services from "Phangan Fun Factory" will be charged. If not mentioned otherwise, every dive trip purchased from "Phangan Fun Factory" includes 2 filled tanks (2 dives). Should you decide not to attend your sceduled dives no refund will be possible. ( see "Liability Release" )

- Own Dive Equipment:
Any dive trip or dive course purchased from "Phangan Fun Factory" which is performed with your own dive equipment will recieve 10% discount on the total amount. Insurance for your dive equipment is available in our "Phangan Fun Factory" offices. "Phangan Fun Factory" can not be held responsible for loss or damage of your own dive equipment, please contact the responsible insurrance.

- Maintenance:
"Phangan Fun Factory" is a certified "AquaLung" maintenance center. Dive equipment from all major brands will and can be maintained with legal guarantees and/or original spareparts.

- Weather dependency:
"Phangan Fun Factory" reserves the right to rescedule dive trips due to weather conditions. "Phangan Fun Factory" will not scedule any dive trips if weather conditions may be of harm for your safety or the safety of staff or personal of "Phangan Fun Factory". Should you be unable to attend a resceduled dive trip, "Phangan Fun Factory" will refund the costs of the diving trip or diving course.

Liability Release:

- Liability Waver:
With the purchase of services provided by "Phangan Fun Factory" you automaticly agree to our "Liability Waver". You, as customer from "Phangan Fun Factory" are responsible to provide us with a filled out "Phangan Fun Factory Liability Waver" (available in our offices or www.phanganfunfactory.com) before going aboard any diving vessel of "Phangan Fun Factory". Violation of this term excludes "Phangan Fun Factory" from ay responsibilities resulting of your actions. Wrong or misstated information, regarding your personal and contact data and/or medical record will exclude "Phangan Fun Factory" from any liability or responsibility regarding you or persons placed in your care.

Children:

- Children:
Children younger than 8 years of age are excluded from any diving service provided by "Phangan Fun Factory". Children older than 8 years of age must provide a "Liability Waver" signed by a parent or legal guardian. Children under the legal age of 18 are not allowed aboard any "Phangan Fun Factory" Vessel without attendance of at least one parent or legal guardian. Children may attend snorkeling services provided by "Phangan Fun Factory" without age restrictions, if attended by a parent or legal guardian.


Privacy Policy:
"Phangan Fun Factory" will collect data about you (Name, Email, Address, etc.) during signup or payment processes or other interactions between you and "Phangan Fun Factory". This data serves the improvement or completition of services towards you or purchased by you from "Phangan Fun Factory" or our partners. Any data shared with our partners (PayPal, SSI, PADI, etc.) is subject to their privacy policys and terms of business. With your registration at the "Phangan Fun Factory" - website, you permit us to supply our partners with the necessary data to process your requests or purchases with "Phangan Fun Factory". You are responsible to keep your private data, such as Username, Password, Email, etc. save and out of reach from unpermitted persons. In case of loss of any of these informations or a suspected misuse of your "Phangan Fun Factory" account please contact us immedeatly, supplying account data to identify the account in question (such as Username, Email, Birthdate, etc.). In case of loss of your email associated with your account at "Phangan Fun Factory", please contact our office via phone or fax, again supplying account data to identify yourself as account holder. "Phangan Fun Factory" may not be held responsible for any loss of data that may occur, or any further occurance related to it.
